§ 1. General Provisions
1. The EkoRolka online store, available at ekorolka.pl, is operated by Puchalik spółka z ograniczoną odpowiedzialnością with its registered office in Krakow, ul. Kazimierza Morawskiego 5/127, 30-102 Kraków, NIP: 6772532651, KRS: 0001202554, hereinafter referred to as the Seller.
2. Contact with the Seller is possible at the e-mail address: kontakt@ekorolka.pl.
3. These Regulations define the rules for using the Store, placing orders, delivery, payment, withdrawal from the contract, and complaints.
§ 2. Definitions
1. Customer: a natural person, legal person, or organizational unit making a purchase in the Store.
2. Consumer: a Customer who is a natural person making a purchase not directly related to their business or professional activity.
3. Product: products offered in the Store.
§ 3. Placing Orders
1. Orders can be placed via the Store's website 24 hours a day, 7 days a week.
2. An order is placed after selecting the Product, adding it to the cart, providing delivery and payment details, and confirming the order with a button indicating an obligation to pay.
3. The sales contract is concluded at the moment the Seller confirms acceptance of the order, sent to the Customer's e-mail address.
§ 4. Prices and Payments
1. Product prices given in the Store are gross prices (including VAT) and are expressed in Polish zlotys.
2. The price does not include delivery costs, which are provided before placing the order.
3. Available payment methods are presented to the Customer during the order placement process.
§ 5. Delivery
1. Delivery is carried out in Poland and to European Union countries.
2. Orders are shipped within 1 business day of payment being credited. The estimated delivery time is usually 2 to 10 business days within Poland and 3 to 14 business days for deliveries to other European Union countries.
3. The delivery cost is indicated in the cart before placing the order and depends on the country of delivery. Orders delivered within Poland with a value of at least PLN 99 are eligible for free delivery.
§ 6. Right of Withdrawal from the Contract
1. The Consumer has the right to withdraw from a distance contract within 14 days without giving any reason.
2. The withdrawal period expires after 14 days from the day on which the Consumer acquired possession of the Product.
3. To exercise the right of withdrawal, the Seller must be informed of the decision, e.g., by sending a statement to kontakt@ekorolka.pl. Details and a sample statement can be found in the Returns Policy.
4. The Seller shall return all payments received from the Consumer, including the costs of delivering the Product (except for additional costs resulting from the Consumer's chosen delivery method other than the cheapest ordinary delivery method offered by the Seller), without undue delay, not later than 14 days from the day of receiving the withdrawal statement, subject to the Seller's right to withhold reimbursement until receipt of the Product or proof of its return.
5. The Consumer bears the direct costs of returning the Product.
§ 7. Complaints
1. The Seller is liable to the Consumer for the conformity of the Product with the contract on the terms specified in the Consumer Rights Act.
2. Complaints can be submitted to the e-mail address kontakt@ekorolka.pl, providing a description of the defect, the date it was discovered, and the requested remedy.
3. The Seller will process the complaint within 14 days of its receipt.
§ 8. Personal Data
The rules for processing personal data are described in the Privacy Policy available in the Store.
§ 9. Final Provisions
1. In matters not regulated by these Regulations, Polish law shall apply, in particular the Civil Code and the Consumer Rights Act, subject to the mandatory provisions of the consumer's country of habitual residence.
2. The Consumer has the possibility to use out-of-court complaint and claim settlement methods, including through municipal or district consumer ombudsmen and the Trade Inspection.
3. These Regulations are effective from the date of publication in the Store.
